3. CITIZEN’S FORUM
Any person desiring to speak on a matter which is not scheduled on this agenda may do so under Citizen’s Forum. Please submit a purple speaker card to the City Clerk prior to the commencement of Citizen’s Forum. Only those who have submitted speaker cards, or have expressed an interest to speak, prior to the conclusion of Citizen’s Forum will be called upon to speak. Please be aware the California Government Code prohibits the City Council from taking any immediate action on an item which does not appear on the agenda, unless the item meets stringent statutory requirements. The City Council can, however, allow its members or staff to briefly (no more than five (5) minutes) respond to statements made, to ask questions for clarification, make a brief announcement or report on his or her own activities. (See California Government Code Section 54954.2(a))

Unless directed otherwise by a majority of the City Council, all questions asked and not answered at the meeting will be responded to in writing within 10 business days.

Adopt Resolution Authorizing the Mayor to Execute a Settlement and Release Agreement with TCN Properties, L.P., Valley Landscaping and Maintenance, Inc., and Developers Surety and Indemnity Company for the Mossdale Linear Park Bonds for Tracts 3073 and 3438 (Bond No.’s 569134S & 569135S) and Surety Bond for Mossdale Landing Business Park Public Improvements (Bond No. 569137S)

4.4 CONTRACT PROFESSIONAL O&M SERVICES WITH THE H2O GROUP FOR THE LAWTF (PW 05-07)
Adopt Resolution Awarding a Professional Services Contract with the H2O Group for Contract Water Treatment Plant Operation and Maintenance Services for the Louise Avenue Water Treatment Facility (PW 05-07)

4.5 CREATION OF CIP GG 12-16 FOR ADA TRANSITION PLAN
Adopt a Resolution Approving the Creation of CIP GG 12-16 to Prepare an ADA Transition Plan

4.6 CREATION OF CIP GG 12-17 FOR SCADA SYSTEM MODIFICATIONS AND APPROVAL OF TASK ORDER NO. 12 WITH MCC CONTROL SYSTEMS
Adopt a Resolution Approving Creation of CIP GG 12-17and Approving Task Order No. 12 with MCC Control Systems for SCADA System Modifications

4.7 ACCEPTANCE OF IMPROVEMENTS COMPLETED PURSUANT TO WW 04-12 MCKINLEY AVENUE SANITARY SEWER MAIN AND PUMP STATION
Adopt a Resolution Accepting Improvements Completed Pursuant to WW 04-12 McKinley Avenue Sanitary Sewer Main and Pump Station from Knife River Construction and Authorizing Filing of a Notice of Completion and Release of Contract Retention

5. SCHEDULED ITEMS

5.1 REFUNDING OF INSTALLMENT PURCHASE CERTIFICATES OF PARTICIPATION, 2000 SERIES A (2000 COPS)
1. Adopt a Resolution Refinancing the Certificates of Participation, Series 2000 A (“2000 COPs”) Using a Tax-Exempt, Bank Qualified Private Placement Loan Provided by BBVA Compass, Authorizing the Borrowing of Funds to Refinance the Outstanding 2000 COPs, and Approving Related Documents and Actions; and
2. Adopt a Resolution Approving a Budget Amendment from the Water System Rate Stabilization Fund in an Amount Not to Exceed $120,000; and
3. Approve Commitment Letter Dated 3/26/2012 from BBVA / Compass Bank for Refinancing the 2000 COPs and Authorize the City Manager to Execute on Behalf of the City

5.2 CAPITAL IMPROVEMENT PROJECT LIST FOR FISCAL YEARS 2012/13 THROUGH 2016/17
